Terms of Service

These Terms of Service ("Terms") govern your use of Focusiva, operated by TFM Software Lab ("we", "us", "our"). By using Focusiva, you agree to these Terms.

1. Service

Focusiva is a productivity and task management application. We provide the service "as is" and strive for high availability but do not guarantee uninterrupted access.

2. Accounts

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your credentials.
  • You must be at least 16 years old to use Focusiva.
  • You may not create multiple accounts for abusive purposes.

3. Acceptable Use

You agree not to:

  • Use Focusiva for any unlawful purpose.
  • Upload malicious code, spam, or harmful content.
  • Attempt to gain unauthorized access to other users' accounts or our systems.
  • Interfere with the proper functioning of the service.
  • Use automated tools to scrape or extract data without permission.

4. Your Content

  • You retain ownership of all content you create in Focusiva.
  • You grant us a limited license to store, process, and display your content solely to provide the service.
  • We will not access your content except as necessary to provide the service or as required by law.

5. Payments

  • Focusiva offers paid subscription plans. Prices are displayed before purchase.
  • All prices are exclusive of applicable VAT.
  • Payments are processed by Stripe. We do not store your full card details.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • You may cancel your subscription at any time. Access continues until the end of the billing period.

6. Termination

  • You may delete your account at any time.
  • We reserve the right to suspend or terminate accounts that violate these Terms.
  • Upon termination, your data will be deleted within 30 days unless retention is required by law.

7. Intellectual Property

  • Focusiva, its name, logo, and design are the property of TFM Software Lab.
  • You may not use our trademarks without prior written permission.

8. Limitation of Liability

To the maximum extent permitted by Austrian law:

  • We are not liable for indirect, incidental, or consequential damages.
  • Our total liability is limited to the amount you paid in the 12 months preceding the claim.
  • We are not liable for data loss resulting from service interruptions.

9. Indemnification

You agree to indemnify us against claims arising from your use of Focusiva or violation of these Terms.

10. Governing Law

These Terms are governed by Austrian law. The exclusive jurisdiction is the Landesgericht Innsbruck, Austria.

11. EU Consumer Rights

If you are a consumer within the EU, you retain any mandatory consumer protection rights under the laws of your member state.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notice at least 14 days before they take effect.
